REAL ID act may cause issues for air travelers

If you plan on traveling any time next year, the question is a pertinent one. Travelers with driver’s licenses from New York, Minnesota, New Hampshire, Louisiana, American Samoa or another state or territory the Department of Homeland Security deems not-compliant with the federal REAL ID act may soon be barred from using theirs as legal identification at the airport.

Up in the air, however, is whether “soon” means early or late 2016 — or a year or more.

DHS has already completed three separate phases of its REAL ID enforcement plan, which covers access to nuclear plants and a wide array of federally protected facilities. However, the next phase adds commercial aircraft to the agency’s access list, and will take place sometime after the turn of the calendar year.

The exact rollout date will be announced soon, said DHS spokeswoman Amanda DeGroff adding that the agency will “ensure that the traveling public has ample notice before any changes are made that could possibly affect their travel planning.”

Until then, DeGroff said the Transportation Security Administration will continue to accept state-issued driver’s licenses and identification cards from all states.

This means some travelers may be in for an unpleasant surprise at airports  next year.

While almost two dozen states issue driver’s licenses that are compliant with the law, numerous others have raised privacy and cost concerns. They, along with some independent advocacy groups, actively oppose the measure.

Some states, like Oklahoma, have laws on their books that explicitly prohibit complying with REAL ID; meanwhile, about two dozen non-complaint states have been granted extensions.

It’s unlikely the rule will take effect January 1, given the hurdles to compliance and the broad opposition.

“We expect that New Yorkers with standard-issue licenses will have more than a year notice before any change is implemented,” said Casey McNulty, a spokesman for the Empire State’s Department of Motor Vehicles. “New York has also applied for an extension to the law.”

When the final phase does ultimately take effect, travelers age 18 and over from states that remain non-compliant will need to a secondary or alternate form of identification. These include a U.S. passport or passport card, or one of the documents TSA’s authorized ID list, to pass through airport security checkpoints.

Travelers who do a little planning shouldn’t have a problem getting on their planes, but “rushes on passports will likely result in delays in getting applications processed,” noted Andrew Meehan, policy director of advocacy group Keeping Identities Safe and a Real ID supporter.

Still, “airports in noncompliant states will likely see long lines as travelers unaware of the changes will be turned away.”

TSA: OK to fly with small knives, golf clubs, other items.

For the first time since the 9/11 terror attacks, the Transportation Security Administration (TSA) will allow small knives and some previously prohibited sports equipment onto airplanes as carry-on items.

According to the TSA, passengers will be able to carry-on knives that are less than 2.36 inches long and less than one-half inch wide. Larger knives, and those with locking blades, will continue to be prohibited, as will razor blades and box cutters, guns, firearms, and the dozens of other things listed on the published list of prohibited items.

TSA will also soon permit sports equipment such as billiard cues, ski poles, hockey sticks, lacrosse sticks up to two golf clubs to be carried onto airplanes. Souvenir, novelty and toy baseball bats — such as wiffle-ball bats — will also be allowed.

The relaxed rules take effect April 25.

TSA said the new regulations will allow its officers to better focus efforts on finding “higher threat items such as explosives,” and was made as part of the agency’s overall risk-based security approach.

But the Flight Attendants Union Coalition issued a statement saying they are unhappy with this move, calling it a “poor and shortsighted decision” by the TSA.

“As the last line of defense in the cabin and key aviation partners, we believe that these proposed changes will further endanger the lives of all Flight Attendants and the passengers we work so hard to keep safe and secure,” the statement said.

TSA believes the items it will now allow in airline cabins are “unlikely to result in catastrophic destruction of an aircraft,” and that policies already put in place — hardened cockpit doors, federal air marshals, crewmembers with self-defense training — reduce the likelihood of passengers breaching the cockpit.

“All TSA is doing is catching up with the rest of the world,” said Douglas R. Laird, president of aviation consulting firm Laird & Associates and former head of security for Northwest Airlines. After 9/11 the TSA “overreacted,” said Laird, and put restrictions in place “in the heat of the moment” that exceeded those in other countries.

Removing small knives and some sports equipment from the list prohibited items “will help align TSA’s list with international standards and help decrease the time spent rescreening or searching bags for these once prohibited items,” said TSA spokesperson Nico Melendez. The changes also enable officers to focus on “the greatest threats … which increase security for passengers and improves efficiency, improving the checkpoint screening experience.”

Tracking a toddler’s airport pat-down

I spent much of Monday morning trying to track down the parent who posted the video (below) of a 3 year-old in a wheelchair getting a very thorough pat-down at an airport security checkpoint.

It turned out the video was shot in 2010 and had been posted on YouTube over the weekend. But that didn’t stop it from going viral.

Here’s my story about the video – and the TSA’s response – that posted on msnbc.com.

A video shot in 2010 showing a 3-year-old boy receiving a pat-down from a TSA agent went viral today. The toddler was wearing a cast and sitting in a wheelchair.

In an annotated videotape of the incident posted March 17 on YouTube, the father is heard reassuring his son, whom he calls “Rocco,” while a TSA officer is seen patting down the squirming boy and taking swabs of the chair and the cast. After asking the parents to lift the boy’s shirt and offering them the option of going to a private screening area, the officer is also shown swabbing the boy’s back.

The video has been viewed more than 400,000 times. [updated]

Before conducting the check at the Chicago Midway Airport, the TSA officer tries to reassure the boy by asking what he likes — “Tigers? Animals?” — and then asks the boy to sit up. During the inspection he also tells the parents what he is doing and tells Rocco that he’s a good boy.

Comments added to the video by his father, said, “I was told I could NOT touch him or come near him during this process. Instead we had to pretend this was ‘OK’ so he didn’t panic.”

Reached Monday morning,  the boy’s father, Matt DuBiel, said the video was made in spring 2010 during a family trip to Disney World.

“We had a baby five weeks ago, and I was looking at some old family videos on Saturday night, and I got incensed and emotional watching it.”

DuBiel says he posted it on YouTube to share it with family members who have heard him talk about the incident but who hadn’t seen the video.

Noting that the incident took place more than a year ago, TSA, in a statement, said: “Due to the fact that this passenger was traveling in a wheelchair and had a cast he would have been unable to pass through the walk-through metal detector or imaging technology and therefore received alternative screening, a pat-down and use of explosives trace detection.”

“It doesn’t matter when it was,” said DuBiel. “That’s the TSA and that is my son. And he is wearing a body cast. The TSA agent did the best he could with a ridiculous situation, but someone should have stepped in and said, ‘That’s enough.’ ” He said he didn’t make a fuss at the time because he was worried about getting the whole family through security. The family was traveling to Disney World.

“At the time, they didn’t  have the rules in place for children that they have now. But, regardless of the new or old rules, my position is that it’s unacceptable to treat a toddler this way.”

Last fall, the TSA revised its rules for children 12 and under, saying they no longer have to remove their shoes at security checkpoints. The agency’s policy for Children with Disabilities states that “if your child is unable to walk or stand, the Security Officer will conduct a pat-down search of your child while he/she remains in their mobility aid, as well as a visual and physical inspection of their equipment.”

“While recognizing that terrorists are willing to manipulate societal norms to evade detection, our officers continue to work with parents to ensure a respectful screening process for the entire family at the checkpoint,” TSA said Monday.

 

What the TSA found at airports – last week

Once again, I find myself perusing the TSA’s weekly round-up of prohibited, illegal and downright bizarre items found at airport checkpoints and thinking… “What’s with people?”

Grenades, pistols, knives and my favorite from last week: thousands of hits of ecstasy stashed in someone’s underpants.
